If you have this badge, , which both of you do, you have Diamond, if you don't, you'd have a black name with no badge.

You two are fine.
If you're talking about Influence, he has Horizon Pro, which is Diamond plus moderation powers, etc.

Can you get banned for this?

I did it in like January with all stats maxed and I got banned for it after like 2 weeks but I am not sure if they still ban for it.

Anybody using it maxed for a while and not been banned?
